General Terms and Conditions

These general terms and conditions apply to all services of PureDigi Business B.V. and on the use of the PureDigi platform.
Article 1 - Definitions
- PureDigi: PureDigi Business B.V., located at Lauwers 9, 9405 BL Assen, Chamber of Commerce 95506284.
- Customer: the natural person or legal entity who enters into an agreement with PureDigi.
- Consumer: a customer who is not acting in the exercise of a profession or business.
- Platform: PureDigi's online website builder and associated services.
- Services: the platform, building websites and all other work provided by PureDigi.
Article 2 - Applicability
These conditions apply to every offer and every agreement between PureDigi and the customer. Deviations only apply if agreed in writing. General terms and conditions of the customer are rejected.
Article 3 - The service
PureDigi offers an online platform that allows customers to build and manage websites, as well as construction and consulting services. PureDigi makes every effort to keep the platform available as best as possible, but does not guarantee uninterrupted availability; maintenance or disruptions may temporarily limit availability.
Article 4 - Account and use
The customer is responsible for maintaining the confidentiality of his login details and for all use of his account. The customer does not use the platform for unlawful purposes and is solely responsible for the content he places on his website.
Article 5 - Offer, prices and trial period
All prices are in euros. For consumers including VAT, for business customers excluding VAT, unless otherwise stated. Current prices and packages can be found on puredigibusiness.nl. Certain subscriptions have a free trial period; If you do not cancel before the end, the paid subscription will commence.
Article 6 - Payment
Payments are made via our payment service provider Stripe. Subscriptions are charged in advance and periodically (monthly or annually). The agreed rate or quotation applies to customized and consultancy services. In the event of late payment, PureDigi may suspend access to the platform.
Article 7 - Customization and additional work
Work outside the agreed package is agreed in advance and carried out at the applicable hourly rate or according to quotation. Custom work already carried out will not be refunded.
Article 8 - Term and termination
Subscriptions are entered into for the agreed period and then tacitly renewed, unless stated otherwise. You can cancel with one month's notice towards the end of the current period, via your account or by email. Amounts already paid for the current period will not be refunded, except for the right of withdrawal for consumers.
Article 9 - Intellectual property
All intellectual property rights to the platform and the underlying software belong to PureDigi. The customer retains the rights to its own content and grants PureDigi the right to use it as necessary to provide the services.
Article 10 - Liability
PureDigi is not liable for indirect damage, consequential damage or lost profits. Liability is limited to the amount that the customer has paid for the service in question in the twelve months prior to the damage. These limitations do not apply in the event of intent or deliberate recklessness and do not affect mandatory consumer rights.
Article 11 - Personal Data
PureDigi processes personal data in accordance with its privacy statement. To the extent that PureDigi processes personal data on behalf of the customer, the agreements in the processing agreement apply.
Article 12 - Right of withdrawal for consumers
Consumers have the right to terminate the agreement within 14 days after conclusion without giving reasons. See our returns policy for terms and conditions.
Article 13 - Applicable law
Dutch law applies to these conditions and all agreements. Disputes will be submitted to the competent court in the district of Northern Netherlands, unless the law stipulates otherwise.
